Terms and Conditions

The Terms and Conditions of ckeller.photo aim to regulate the business relationship between you and us in a binding and fair manner. Therefore, the basis of an order and a contract are always the following General Terms and Conditions, the knowledge and inclusion of which you acknowledge and confirm by placing an order with ckeller.photo.

§1 Scope

1.1 The business relationship between ckeller.photo and the orderer shall be governed exclusively by the following General Terms and Conditions in the version valid at the time of the order. Any deviating terms and conditions of the orderer shall not be recognized by ckeller.photo, unless ckeller.photo has expressly agreed to their validity in writing.

1.2 Customer in the sense of these GTC are exclusively consumers.

1.3 According to § 13 BGB (German Civil Code), a consumer in the sense of these General Terms and Conditions is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity.

§2 Conclusion of contract

2.1 The product descriptions contained in the online store of ckeller.photo do not constitute binding offers for the conclusion of a contract on the part of ckeller.photo. They do, however, represent an invitation for the customer to submit a binding offer.

2.2 The customer can log in to his possibly existing customer account by pressing the “My Account” button and entering his access data (email address and password) in the fields provided. New customers can create a new account here by entering their email address in the appropriate field. After clicking on the button “Login” or “Register” the customer gets to his account, where an overview of the orders, the purchased photos can be downloaded, the address can be customized and especially the account details can be customized.

2.3 The customer can submit the offer via the online store ordering system of ckeller.photo. The customer can select individual products under the menu item “Shop” and add them to the virtual shopping cart by clicking on the button “Add To Cart”. After clicking on “Cart”, the contents of the virtual shopping cart can be displayed in a separate window. The customer then has the choice of adding more products by clicking on the “Shop” button or proceeding to the ordering process by clicking on the “Proceed to Checkout” button.

To enter the ordering process, the customer is prompted to enter the billing address after pressing the “Proceed to Checkout” button. In addition, an overview of the products in the shopping cart is displayed. Before completing the order, the customer must agree to the “Terms and Conditions”, the “Right of Revocation” and the “Terms and Conditions” and agree to the provisions on the right of revocation.

2.4 ckeller.photo may accept the offer of the customer within five (5) days by sending a confirmation letter to the customer (e.g. by e-mail) or by delivering the ordered goods to the customer; in the first case, the receipt of the declaration of acceptance shall be decisive, in the latter case, the receipt of the goods by the customer. If no acceptance is made by ckeller.photo within the time limit, this shall be deemed as rejection of the offer. In this case, the customer is then no longer bound to his declaration of intent.

2.5 The period for acceptance of the offer begins on the day after the customer sends the offer and ends at the end of the fifth (5th) day following the sending of the offer.

2.6 The contract text is stored by ckeller.photo and sent to the customer in text form (e.g. by e-mail) after sending his order including the GTC as well as the cancellation policy. In addition, the customer receives a message about this in the browser window after the order has been placed; this message contains the option to print out the order confirmation. Furthermore, the text of the contract is stored in the online store of ckeller.photo and can be retrieved by the customer in his customer area at any time after entering his access data under the menu item “Orders”.

2.7 Only the German language is available for the conclusion of the contract.

§3 Revocation

3.1 Further information on the right of revocation can be found in the ckeller.photo revocation policy under the menu item »Power of Revocation«.

§4 Prices / Terms of payment

4.1 The prices stated in the online store of ckeller.photo are final prices. The prices therefore include in particular the statutory sales tax and, however, no shipping costs. However, since the purchased photos are sent by email, there are no shipping costs.

4.2 In the case of deliveries to countries outside the European Union, further costs may be incurred in individual cases for which ckeller.photo is not responsible and which are to be borne by the customer. These include, for example, costs for the transfer of money by credit institutions (e.g. transfer fees, exchange rate fees) or import duties or taxes (e.g. customs duties). Such costs may also be incurred in relation to the transfer of funds if the delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union.

4.3 The following payment options are available to the customer: Paypal.

4.4 If the payment method PayPal is selected, the payment will be processed via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, subject to the PayPal terms of use, which can be viewed online at https://www.paypal.com/de/webapps/mpp/ua/useragreement- full in the case of an existing PayPal account or at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full, if the customer does not have a PayPal account.

§5 Delivery/Contractual terms

5.1 Delivery of the goods will be made no later than within five (5) business days (Monday to Friday, holidays excluded) after the conclusion of the contract (in the case of PayPal).

5.2 The goods will be shipped to the email address provided by the customer in the ordering process, unless otherwise agreed in individual cases.

5.3 The risk of accidental loss and accidental deterioration of the goods sold shall pass to the customer upon handover of the goods.

§6 Retention of title

If ckeller.photo makes advance payments, it shall retain title to the delivered goods until the purchase price owed has been paid in full.

§7 Information on liability for defects

The statutory liability for defects shall apply.

§8 Information on online dispute resolution

The EU Commission provides an internet platform for online dispute resolution (so-called ODR platform). This ODR platform is intended to serve as a contact point for the out-of-court settlement of disputes in connection with contractual obligations arising from online purchase contracts. §9 Applicable law

9.1 The law of the Federal Republic of Germany shall apply to all legal relations of ckeller.photo with the customer, excluding the laws on the international purchase of movable goods. However, this choice of law shall only apply to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the customer has his habitual residence.

9.2 Furthermore, this choice of law with regard to the statutory right of withdrawal shall not apply to customers who do not belong to a member state of the European Union at the time of conclusion of the contract and whose sole place of residence and delivery address are outside the European Union at the time of conclusion of the contract.
